Will I Go to Prison For Aggravated assault?

There are several different scenarios in which somebody can be charged with aggravated assault.

These situations include: inflicting serious bodily harm against a person – this would include punching somebody and breaking their nose or any other bone, assaulting a police officer – even if the officer was not injured, assaulting medical personnel – even if the person was not injured. In addition to aggravated assault, a person can be charged with aggravated assault with a deadly weapon. For example, if a person points a gun at somebody even if the person does not pull the trigger, they will be charged with aggravated assault. Another type of aggravated assault is if a person commits assault on a child who is under the age of 15 – again, the minor does not have to be injured – the mere fact that a minor was assaulted with fall under the aggravated assault statute.

So, the answer as to whether or not you will go to jail if charged with aggravated assault depends on the type of aggravated assault you’re charged with. Some aggravated assault charges are treated more seriously than others. For instance, if an aggravated assault is committed on a child, the prison sentence is mandatory and significantly more than any other type of aggravated assault. A person charged with aggravated assault could be looking at up to 15 years in prison.
